Michael Black KC joining panel to discuss ADR approaches to avoiding and resolving construction disputes

Michael Black KC will present at the SCL 2023 Annual Conference in Boston, Massachusetts on July 18 2023.

Michael will join a panel entitled ‘Out of the box ADR approaches to avoiding and resolving construction disputes’. Despite the common use of standard form contracts and the typical issues that arise, disputes in the construction industry are not always one-size-fits-all. Thankfully, arbitration and other ADR methods can be adapted to varying circumstances, and even assist parties in avoiding disputes before they reach a boiling point. This panel will explore some scenarios in which out-of-the-box approaches can have a positive impact on avoiding escalation or efficiently resolving construction disputes.

The panellists will discuss recent experiences where they saw the successful use of innovative ADR techniques to efficiently resolve a dispute, or saw a missed opportunity to do so. The panelists will offer tips from their experience, and also give their views on recent institutional efforts to codify innovative dispute resolution mechanisms for the construction industry and whether these efforts are helping or hurting the process.

Michael will be joined on the panel by Wendy Venoit (Cozen O’Connor), Boston, Massachusetts, USA, Roberto Hernández-Garcia (Comad, S.C.), Mexico City, Mexico and Anya Marinkovich (Bär & Karrer), Geneva, Switzerland.

The conference is hosted by The Society of Construction Law North America in cooperation with The Texas Institute of Continuing Legal Education.
