XXIV Old Buildings’ members draft new Bermuda firewall legislation

The Bermuda Parliament has enacted the Trusts (Special Provisions) Amendment Act 2020, which enhances and clarifies the ‘firewall’ that prevents the application of foreign laws and foreign orders to certain questions involving Bermuda trusts. The legislation also clarifies the Bermuda court’s jurisdiction to determine matters involving Bermuda trusts and other trust cases with a Bermuda connection.

The 2020 Act was drafted by Andrew Holden and David Brownbill QC, instructed by the Bermuda Trust Law Reform Committee.
