XXIV Old Buildings recently hosted a commercial litigation conference at the Lincoln Centre in London.
The conference examined key current issues arising in litigation relation to joint venture disputes by reference to a written problem, offering the critical insights and experiences of QC’s and specialist counsel.
The talks covered:
- Issues and remedies in joint venture disputes. Stuart Adair considered the remedies available in joint venture disputes and some of the issues that arise in the context of such disputes, with particular reference to recent derivative litigation against the directors of BP in the United States (in which he was involved), unfair prejudice petitions and issues relating to the ratification of breaches of duty.
- Diversion of corporate opportunities and proprietary claims. Elizabeth Weaver and Adam Cloherty examine the remedies for diversion of corporate opportunities and proprietary claims generally after Sinclair v Versailles, with particular reference to Grimaldi v Chameleon Mining and Cadogan Petroleum v Tolley.
- Cross-border insolvency and the enforcement of foreign judgments. Alan Steinfeld QC and Edward Knight considered the issues arising in cross-border insolvencies, including the application of section 427 of the Insolvency Act 1986 and the Foreign Judgments (Reciprocal Enforcement) Act 1930, with particular reference to Rubin v Eurofinance SA and Re New Cap Reinsurance Corporation Ltd, which were recently before the Supreme Court and were cases in which XXIV Old Buildings was involved.
- An application for interim relief. Steven Thompson considered freezing injunctions and made a mock application for injunctive relief.
- Contempt of court and committal. Robert Levy QC examined recent developments in the law relating to contempt of court and committal, with particular reference to JSC BTA Bank v Solodchenko.
