Timothy Sherwin pens article for Trusts & Estates Law and Tax Journal

Timothy Sherwin is pleased to have had his article “Trusts: Striking an artful balance” (subscription required) published in November’s edition of the Trusts & Estates Law and Tax Journal.

In the article, Timothy analyses the recent Court of Appeal decision in Staechelin v ACLBDD Holdings Limited [2019] EWCA Civ 817, [2019] 3 All ER 429 in detail, focusing in particular on Lewison LJ’s introduction of the “indoor management rule” from Company law to Trust law situations, and on the development of the unanimity principle in respect of trustees’ decision making.

Further in his paper, Timothy provides practical advice for trustees who hold and manage art and cultural property in the light of the, unusual, facts of the case.
