Thames Water Utilities Holdings Ltd, Re [2025] EWHC 338 (Ch) (18 February 2025)
In his judgment, handed down on 18 February 2025, Leech J sanctioned the Thames Water £3bn restructuring plan.
The public interest intervention was on the basis that a special administration would be a much better solution for Thames Waters’ systemic financial and operational problems.
The Judge, “after taking into account the public interest in ensuring the uninterrupted provision of vital public services” nevertheless exercised his discretion to sanction the Plan.
Permission to appeal was granted and an expedited Court of Appeal hearing is expected in the coming weeks.
