Hastings Bass and the implications of the Futter case

We are pleased to attach an article on the rule in Hastings-Bass and the implications of the Futter case in particular, co authored by Adam Cloherty together with an academic from Cambridge University, on the implications of the Futter case, for the latest issue of the Law Quarterly Review.

The piece complements some of the arguments developed by Adam and Nicole Langlois in their article published earlier this year (“Playing the Get Out of Jail Free Card: Mistake in the Law of Trusts” [2010] Jersey &Guernsey Law Review 1 – 38), in particular as to the remedial consequences of invoking the Hastings-Bass jurisdiction.
