The Companies Act 2006 significantly expanded the scope of traditional shareholder remedies, with many questions about the precise limits of the post-codification rules still being determined today. In this panel, Steven Reed, Timothy Sherwin and Harry Samuels look at unfair prejudice petitions and derivative proceedings, and discuss some practical and tactical considerations for litigators emerging out of the recent case law.
