Wilson v Dodd & Anor [2012] EWHC 3727 (Ch)

Stuart Adair recently obtained a successful outcome for the American Claimant in this fraud case. The court held that a statement that a third party had invested could amount to a fraudulent misrepresentation when the defendant knew:

(a) the third party had not invested; and
(b) that such a statement would be material to the claimant’s decision whether or not to invest.
