Andrew Holden is a commercial chancery specialist. His highly-regarded practice encompasses traditional chancery work (trusts, probate, estates, and other specialist chancery work); commercial disputes (including business litigation, fraud, and asset tracing); and international arbitration.

In the United Kingdom, Andrew enjoys a busy and broad-based commercial chancery practice. He is well known for his traditional chancery work, with Chambers and Partners praising him as “a sought-after junior for his broader traditional chancery expertise”. Andrew is also a leading commercial disputes practitioner, with a particularly busy and successful practice in complex fraud, asset-tracing, and jurisdiction and enforcement litigation.

Andrew also has an extensive international practice. He “has an amazing offshore practice. He is involved in a staggering amount of offshore litigation.” He is particularly adept at handling large offshore disputes and often acts in high profile, multibillion-dollar disputes in key jurisdictions.” He has particular experience acting for the settlors, trustees, beneficiaries, and protectors of private trusts, as well as for the custodians, directors and professional advisers of companies, funds and other complex offshore structures. Client feedback is that he is an “outstanding trusts specialist.” He is said to have encyclopedic trust knowledge in several jurisdictions” with one client saying that “there is nothing in the trusts world that he is not familiar with.” Andrew also has a high-profile international commercial litigation and arbitration practice, including cross-border fraud and asset-tracing and connected matters engaging principles of international jurisdiction and enforcement.

Andrew is the author of Trust Protectors, the first specialist practitioners’ text on the subject of protectors, and writes and publishes regularly in his fields of expertise. He is an Academician of The International Academy of Estate and Trust Law (TIAETL), a full member of The Society of Trust and Estate Practitioners (STEP), and the draughtsman of several pieces of offshore legislation, including the Trustee Amendment Act 2014 and the Trusts (Special Provisions) Amendment Act 2020 of Bermuda.

In addition to his practice at the Bar, Andrew sits on a fee-paid (part-time) basis as a Deputy Master of the Chancery Division.

Expertise

Andrew has regularly acted, both as sole counsel and as part of a counsel team, in arbitral proceedings seated in both London and internationally. Some examples of his international arbitration practice are set out below.

Andrew has particular expertise in trust arbitration, having acted in the first major reported case relating to trust arbitration. Andrew also prepared the Chancery Bar Association’s response to the Law Commission’s Report leading to the enactment of the Arbitration Act 2025.

  • LCIA Arbitration (2024-2025) (London seat): Acted for the claimants as sole counsel in a €60 million breach of contract claim arising out of a Share Purchase Agreement.
  • Volpi v Delanson Services Ltd, 2020/APP/sts/00013(Bahamas seat): A challenge and appeal against an arbitral award made in an UNCITRAL arbitration relating to a breach of trust claim on grounds of lack of jurisdiction, serious procedural irregularity and error of law. Led by Michael Black KC.
  • LCIA Arbitration(2021-2022) (London seat): Acted for the defendants in an arbitration concerning alleged breaches of $150 million of loan notes. Led by Michael Black KC.
  • CIArb Arbitration (2014) (London seat): Acted as sole counsel in an arbitration relating to fiduciary remuneration and expenses.

Andrew has a strong fraud and asset tracing practice in both England and Wales and internationally. He has been involved in many major multi-jurisdictional asset tracing exercises as part of a team of counsel, and also has extensive experience as sole counsel obtaining freezing injunctions, and ancillary asset tracing and disclosure orders. Andrew also has extensive experience in civil enforcement actions. Some examples of his civil fraud and asset tracing practice are set out below.

  • Heritage Travel & Tourism Ltd v Windhorst [2023] 6 WLUK 458 (Commercial Court): Andrew acted unled for the claimant in obtaining an order declaring that Lars Windhorst had acted in contempt of the English High Court, and conducted the subsequent high-profile cross-examination of Mr Windhorst on his worldwide assets as part of an exercise to enforce a €172 million judgment debt.
  • Yuntian 10 Leasing Company v Dream Aircraft Ltd (2023): Acted for the claimant on a major asset tracing and enforcement exercise relating to breach of a lease of a Boeing 787 Dreamliner. The claim involved obtaining a charging order over one of the UK’s most valuable properties – ‘The Holme’ in Regent’s Park, London.
  • YM v NM [2020] EWFC 13 (High Court, Family Division): Acting for the respondent, Andrew successfully opposed an application by the applicant wife for a freezing injunction in the context of matrimonial proceedings.
  • Akhmedova v Akhmedov [2018] DIFC CFI 011; [2018] DIFC CA 003 (DIFC Court of First Instance and Court of Appeal); [2018] EWFC 23 (Fam); [2018] 3 FCR 135 (High Court, Family Division): A major international asset tracing exercise arising out of the largest divorce award ever granted by the English High Court. The claim involved in particular steps to enforce that award against MV ‘Luna’, a superyacht valued at in excess of $450 million. Led by Michael Black KC (in the DIFC) and Dakis Hagen KC (in England).
  • Ras Al Khaimah Investment Authority v Bestfort Development LLP [2015] EWHC 3197 (Ch) (High Court, Chancery Division); [2016] 2 CLC 714 (Court of Appeal); [2018] 3 WLR 1099 (Court of Appeal): Andrew acted for one of the United Arab Emirates in claims arising out of an alleged multi-million dollar fraud in the Republic of Georgia. The matter gave rise to important judgments in the Court of Appeal concerning the availability of security for costs and the proper test for the making of freezing injunctions. Led by Stephen Moverley Smith KC and Richard Millett KC.

Andrew has a well-established commercial practice, often acting for parties in business disputes relating to e.g. claims for breach of contract; shareholder and other corporate disputes; banking and financial services litigation; and in connected applications involving jurisdiction and enforcement. Andrew’s specialist chancery expertise often leads to instructions in respect of claims for breach of fiduciary duty and related proprietary remedies to recover misapplied assets. Some examples of Andrew’s commercial litigation practice are set out below.

  • Mozambique v Privinvest Shipbuilding SAL (Holding) [2025] EWHC 1481 (Comm) (Commercial Court): Andrew is acting for the family members of the late Iskandar Safa in respect of a dispute regarding the English court’s jurisdiction to join family members as defendants in the context of a fraud claim against the deceased (led by Robert Howe KC).
  • Perrucci v Orlean Invest Limited [2022] EWHC 2038 (Comm) (Commercial Court): Acted unled for the defendant in successfully resisting a strike out/summary judgment application in respect of a very high value commercial claim.
  • Volpi v Volpi [2021] EWHC 2143 (Ch) (High Court, Chancery Division); [2022] EWCA Civ 464 (Court of Appeal): Andrew acted unled in successfully resisting a claim that a CHF 6 million loan agreement was a forgery, and in successfully opposing the appeal against that judgment in the Court of Appeal.
  • Richards v Kulczyk [2022] EWHC 863 (Ch) (High Court, Chancery Division): Acted unled for the defendant trustee in proceedings claiming c.£7 million under an alleged oral contract and/or in restitution.

Andrew has very extensive experience in offshore proceedings, in both the trust and commercial contexts. He has acted in major litigation in all of the main international financial centres, including: The Bahamas, Bermuda, the BVI, the Cayman Islands; the DIFC; Gibraltar; Guernsey; Hong Kong; the Isle of Man; and Jersey.

Andrew has deep experience working for and with local counsel in, and is very familiar with the court systems and civil procedural rules of, all of these jurisdictions.

  • Bahamas – Dawson-Damer v Grampian Trust Company Ltd [2025] UKPC 32; [2025] 1 WLR 3530 (Privy Council): Acted for the Plaintiff in proceedings in the Supreme Court and Court of Appeal of The Bahamas and in the Judicial Committee of the Privy Council relating to a very high-value breach of trust claim. Led by Richard Wilson KC.
  • Gibraltar – AB v Line Trust Corporation Ltd [2022] GSC 002 (Supreme Court); [2025] GCA 004 (Gibraltar Court of Appeal): Acted unled for the trustees of a nine-figure trust structure. The litigation gave rise to important judgments concerning the privacy of trust proceedings.
  • Jersey – Representation of Summit Services Limited; Re B, C, D and E Trusts [2024] JRC 222 (Royal Court). Acted for the Representor on a successful trustee blessing application. Assisted Advocate Dann.
  • Gibraltar – Re Sternbuch Family Trust [2023] GSC 10 (Supreme Court). Acted unled for the  successful claimant on a claim to correct a mistake causing a multi-million pound tax liability.
  • Bahamas – Hamersmith-Stewart v Cromwell Trust Company Ltd (2022-ongoing) (Supreme Court and Court of Appeal): Acting for Plaintiff in major trust litigation, including important judgments concerning the privacy of trust proceedings. Led by Simon Taube KC.
  • Cayman Islands – Re X and Y Trusts (2022) FSD/57/2022 (Grand Court): Order addressing potential Guardian Trust liability in the context of third party proprietary claims. Led by Elspeth Talbot Rice KC.
  • Jersey – Re Piedmont & Riviera Trusts [2015] JRC 196[2016] JRC 016[2018] JRC 210[2021] JRC 248 (Royal Court): Acted for the applicant beneficiary in this groundbreaking multi-year trust litigation in Jersey, involving (i) setting aside appointments of fiduciaries for irrationality; (ii) setting aside deeds of revocation for undue influence; (iii) the proper role of a protector in consenting to/vetoing a trustee’s decision; and (iv) fiduciary costs in trust proceedings. Assisted Advocate Robertson.
  • Bermuda – Re X Trusts  [2018] SC (Bda) 56 Civ (Supreme Court): Acted for a group of beneficiaries in respect of a novel application in Bermuda to remove the directors of Private Trust Companies from office. The matter involved a breakdown in relations concerning a trust structure worth in the region of £5 billion and gave rise to an important judgment concerning the breadth of the court’s supervisory jurisdiction. Led by David Brownbill KC.
  • Guernsey – Re K Trust [2016] WTLR 1225 (Royal Court): the first reported protector removal claim in Guernsey. Assisted Advocate Wessels.

Andrew has a very well-established traditional chancery practice. As well as practising internationally in various offshore trust jurisdictions (see ‘Offshore Litigation’), Andrew has a thriving and successful domestic trusts, probate, and estates practice.

Andrew often deals with both contentious trust and estate litigation (e.g. trustee and executor removal claims; breach of trust claims; probate claims; Inheritance Act claims) and more specialised chancery proceedings (e.g. blessing applications; VTA applications; forfeiture cases; mistake and rectification claims).   • Re WCC Henchley Trust; Henchley v Thompson [2024] EWHC 607 (Ch); [2024] WTLR 559; [2017] EWHC 225 (Ch); [2017] WTLR 1289 (High Court, Chancery Division): Acted for one of the UK’s most successful entrepreneurs in a very-long running dispute over the administration of a family trust structure. Important judgments relating to nature and extent of trustee’s duty to account. Led by Elspeth Talbot Rice KC and Ian Clarke KC.
  • Withers Trust Corporation Ltd v Goodman’s Estate [2023] EWHC 2780 (Ch); [2024] WTLR 763 (High Court, Chancery Division): Acted unled for the successful applicant on a relief from forfeiture claim in respect of a tragic assisted suicide case.
  • Freed v Saffron Management Limited [2023] EWHC 1919 (Ch) (High Court, Chancery Division): Acted unled for the claimant to a trustee removal claim in successfully resisting an application to strike out the claim.
  • Macmillan Cancer Support v Hayes [2017] EWHC 3110 (Ch); [2018] WTLR 243 (High Court, Chancery Division): Acted unled to obtain full relief from forfeiture for the beneficiaries of a man who had unlawfully killed his wife as a ‘mercy killing’.
