April 14, 2014

Andrew Holden contributed to the third edition of “Probate Disputes and Remedies“, co-authored by Dawn Goodman, Paul Hewitt and Henrietta Mason of Withers LLP and published by Jordans.

Probate Disputes and Remedies provides clear, practical and in-depth guidance to the law and procedure of contentious probate work. Adopting a problem-solving approach, the work highlights specific difficulties that are likely to be encountered in practice, discusses the advantages and disadvantages of each course of action and points out the potential pitfalls along the way.

The work deals with the following matters:

  • Disputed lifetime transactions and the Court of Protection
  • Coroners’ inquests and burial disputes
  • Obtaining the grant – dispute and resolution
  • Disputes relating to the will
  • Estate administration disputes
  • Disappointed beneficiary claims
  • Creditor claims and insolvent estates
  • Claims against professional advisers

Andrew’s contribution focussed on the regulatory and disclosure obligations of personal representatives in relation to claims of tax evasion, criminal conduct, money laundering and terrorism, in both a domestic and an international context.
